Experience
John Faught has practiced law for more than 30 years. Most of his practice has been in the area of environmental law and litigation, including the law and regulations under the Clean Air Act and its amendments, the Clean Water Act, RCRA, CERCLA, UMTRCA, the Oil Pollution Act, and NEPA.
  • In April 1984, John started his own firm, John Faught & Associates. The firm played a leading role in a number of major environmental matters in Colorado. John handled several large CERCLA, RCRA and UMTRCA matters, involving numerous parties. John is now continuing that role by joining forces with his long-time friend and colleague, John Fognani.
  • John's practice in the environmental area has provided a unique opportunity to be involved with the legislative, executive and judicial branches of government at all levels.
  • The timing of John's practice of environmental law provided the opportunity to participate in the federal legislative and rulemaking processes. John was intimately involved in many of the processes establishing the legal framework of our existing environmental laws and regulations. John also has litigated numerous cases in federal district courts and U.S. Courts of Appeals. In November 1990, he had the privilege of arguing a case before the United States Supreme Court.
  • John's environmental practice also has provided the opportunity to work with state and local governments. He has drafted legislation and has worked with legislators and the Governor's office in passing state environmental laws. He also has worked extensively with the Colorado Department of Public Health and Environment and various commissions, such as the Colorado Water Quality Control Commission and the Colorado Air Quality Control Commission, in rulemaking and other administrative matters. He has litigated cases before state district courts and has argued cases before the Colorado Court of Appeals and the Colorado Supreme Court.
